Official Rules – 2017 Giant Crankworx Dream Contest

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. INTERNET ACCESS AND A VALID E-MAIL ADDRESS ARE REQUIRED TO ENTER THE PROMOTION. VOID WHERE PROHIBITED.

Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules.


Eligibility:

Giveaway is open to everyone who is 16 years of age or older. Winner contestant must be 18-years-of-age to go on the Dream trip or accompanied by a parent.


Giveaway Start Date March 22, 2017 - June 30, 2017.

Not Eligable:
Employees, officers, and directors (including immediate family members and members of the same household) of the Sponsor, its parent company, subsidiaries, affiliates, retailers, distributors and advertising and promotion agencies, prize suppliers, and any other entities directly associated with this giveaway, are also not eligible to participate. All federal, state and local laws and regulations apply. Void where prohibited.


Ways to Enter: Eligible participants can be entered into the Giveaway by:
1) Visiting the Sponsor’s contest news article page located at http://www.pinkbike.com/news/giant-crankworx-whistler-dream-trip-contest-2016.html . Once you have access you must complete all the requested information on the entry form during the Giveaway Period to be eligible for the prize drawing.

LIMIT one entry per person, per email address. Once submission is final, an entry cannot be deleted, canceled or modified. Participants should enter using only an e-mail address subscribed and registered in their name. In the event of a dispute as to Online Entries submitted by multiple individuals using the same e-mail account, subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.

Drawing and Notification: A single grand prize winner will be selected from among all eligible entries received on or before the last day of the contest (July 3, 2017), 5pm PST by the Sponsor, whose decision is final and binding in all matters relating to this Giveaway. The winning selection will based on the following criteria: Winner will be chosen randomly by Giant Staff. Odds of winning will depend on the total number of eligible entries received. The Grand Prize winner will be notified by email (the one provided at time of entry) and must respond by email reply to confirm their name, phone number, shipping address for prize and eligibility within three days (3) calendar days of the email notification. Failure to comply may result in disqualification and selection of an alternate winner from all eligible entries received during the applicable weekly entry period. Sponsor is not responsible for any change of e-mail address, mailing address and/or telephone number of entrants. The return of any prize/prize notification as undeliverable or the non-compliance with any other requirement may result in disqualification and an alternate winner will be selected. Also there is only one prize winner per household within a calendar year, no exceptions.

Prize:
Following the conclusion of the Promotion, one (1) Grand Prize winner will receive either of the following. The winner gets to choose one or the other. Not both:

Bike Prize:
• Giant Trance Advanced Complete Bike or Trance Advanced Frameset SRAM Eagle + Rockshox Build.
• Bike prize will be based on this similar build or complete Giant model year bike of current available inventory.
• By entering the contest, the winner agrees that he or she may not get the exact bike pictured in the contest images. Color, components, and model year may vary due to availability of bike and parts.


OR (Winner CHOOSES either the BIKE or TRIP, NOT Both)

Dream Trip:
• If winner chooses Trip. They must be 18-years-old or older. Or, if younger accompanied by their parent.
• Airfare for the winning contestant and their friend.
• 5 nights lodging, Wednesday Aug. 16 – Sunday Aug. 20, 2017
o Arrive Wednesday evening, August 16.
o Depart Monday morning August 21.
• Whistler bike park lift tickets.
• VIP access to viewing areas.
• Giant bike for you and your friend to use during your stay.
• Hang out with the Giant Factory Off-Road Team.

Prize Conditions: By accepting the Grand Prize the winner agrees to release the Sponsor, its parent company, subsidiaries, affiliates, retailers, distributors and advertising and promotion agencies, prize suppliers, and any other entities directly associated with this giveaway (collectively, “Released Parties”),along with each of their respective directors, officers, employees, shareholders and agents, from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the promotion or for damages of any kind caused by any prize or resulting from acceptance, possession, or use/misuse of any prize awarded. Grand Prize winner will be solely responsible for all federal, state and local taxes. No substitution or transfer of prize or election of cash in lieu of prize will be permitted. The Sponsor and prize suppliers reserve the right at its sole discretion to substitute any prize package with another prize of equal or greater value in the event that the prize (or any component thereof) is not available.

The Grand Prize winner will be required to sign an Affidavit of Eligibility and

Liability/Publicity Release to be returned within three (3) calendar days of the email notification, or prize may be forfeited and an alternate winner selected. If a prize or prize notification is returned as unclaimed or undeliverable to a potential winner, or if potential winner cannot be reached within three (3) calendar days from the first notification attempt, or if a potential winner fails to return a requisite document within the specified time period, or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified and an alternate winner will be selected for any prize at issue. All taxes, if applicable, are the sole responsibility of the winner. The winner’s entry and acceptance of any prize offered constitutes permission (except where prohibited) for the Sponsor and prize suppliers to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.

Internet Limitations of Liability: If for any reason this Giveaway is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the
Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Giveaway, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Giveaway in whole or in part, at any time, without notice and award the Grand Prize using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Giveaway or downloading any materials in this Giveaway.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Use of Data: Sponsor will be collecting personal data about entrants online, and e-mail addresses from entry forms in accordance with its Privacy Policy. By participating in the Giveaway and providing your e-mail address, entrants hereby acknowledge and agree to Sponsor’s collection and usage of their personal information as stated in the Sponsor’s Privacy Policy and also agree that Sponsor may share this information with the prize suppliers and its distributor network to alert entrants of future promotions and offers.
Terms & Conditions: This Giveaway is subject to all applicable federal, state, and local laws. By entering the Giveaway, entrants agree to release, discharge, indemnify and hold harmless the Released Parties, and each of their respective directors, officers, employees, shareholders and agents from any and all liability, loss, damage or injuries to any person (including death) or property of any kind sustained in connection with their participation in the Giveaway or from their acceptance, receipt, possession and/or use or misuse of any prize, or for any typographical or other error in the printing, offering or announcement of any prize. Entrants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to any prize, including, but not limited to, its quality or fitness for a particular purpose. Any person attempting to defraud or in any way tamper with the Giveaway mechanics and/or implementation will be prosecuted to the fullest extent of the law. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, and waive any right to claim ambiguity in the Giveaway or these Official Rules. Sponsor reserves the right to disqualify any entrant that Sponsor determines, in its sole discretion, violates these

Official Rules. This Giveaway is void where prohibited.

DISPUTES: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official
Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
