It was added to the to Georgia flag in 1956, 2 years after Brown vs The Board of Education. The govenor who passed the resolution to do so all but admitted that it was a protest of anti-segregation. It was raised over the South Carolina capital in 1961, right as the Civil Rights movement was beginning to be taken seriously.
In short, it was never the official flag of the confederacy, & almost all modern usage is tied to anti-civil rights groups. It shouldn't banned, because free speech is enshrined in the constitution, but it shouldn't be flown in any official capacity by the US or a state government, because it's history is modern, and hostile to Black Americans.
