Rémy Métailler Denied US Entry, Won't Be At Rampage

The list of riders unable to make it to the 2017 edition of the biggest freeride event in mountain biking continues to grow. Rémy Métailler has been denied access to the US with border security stating that the "purpose of the trip is to make money as a professional athlete".

R my managed to find his type of line at Red Bull Rampage 2016. Quite a lot of speed and some pretty technical stuff.

Rémy informed us that his original efforts to the border were with a valid ESTA (and his passport, of course), which is suitable for individuals who meet the criteria, including "planning to travel to the United States for business or pleasure". Since being denied access initially he has sought the assistance of lawyers, volunteered to refuse any kind of money as part of the event, whether prize money or the $5,000 in athlete expenses covered by the event promoters, and has had help from the French Consulate in Vancouver. Despite all efforts from the parties involved, he has been informed to obtain a work visa (which will take up to two months if expedited).

Unfortunately, the line-item stating individuals traveling for business are allowed entry with an ESTA appears to be somewhat misleading with it not covering athletes participating in events within the US. That would include all athletes, whether a young basketball or soccer team from another nation or a professional athlete, whether earning any money in the US or not. As stated on the B1 visa page of the Work Permit website. "B-1 Business Visitor Ineligible Activities include; Participating as a professional in entertainment or sporting events."

At this point, Rémy will not be attending Rampage unless he is somehow able to sort out a visa, and quick.

 @mazze: this actually happens all the time, way before Trump. As a permanent resident having held various visas in the past (read: pre-Trump) I can guarantee you this is not new.

Once you get refused it's giant pain to enter the US *EVER* again as you need a visa every time after that (no more ESTA for you).
Also, business does NOT mean making money, and it's easy, especially when English is not your mother tongue, to mess that up. If you're a bit difficult AND you get it wrong you will be denied every time, all the time. Even if you're not difficult you may get denied if you get that wrong. I have colleagues that got denied in 2010 for the exact same reason, and ALL immigration lawyers tell us all the time to be extremely careful about this very specific case.

I do hope Remy will be able to get there next time though, and it sucks he couldn't enter this time.

ps: here's one that always get my American friends eye's rolling: when applying for permanent residency, since Obama's 2nd term, you have to give a skin sample for DNA (in addition to blood, pee, and other "standard" stuff). For some reason they don't get the DNA from the blood samples (I guess it's standardized tests and blood is used to check if you have diseases)

Don't pretend this is a new state of affairs for the US! In 2007 I remember trying to fly into Vancouver, but unfortunately had a connection flight in the states. I was bluntly and somewhat aggressively asked 3 times what my 'intentions' in America were. I calmly stated each time that I intended to Canada, don't know why it took 3 goes but he got it in the end.
The US has had strict visas and entry requirements, and been cautious of its visitors for a long time, I'm not saying it's necessarily a bad thing, or a good thing, just an observation.
Also, don't drag Australia into this!!

 It's amazing how all you bikers think it's Trumps fault. How ignorant! It has NOTHING to do with him. These are laws and if you have any problem in your background, try and get into our northern neighbor, Canada. They will not let you in. Cam Zink, my son, had a legal issue as a juvenile and was denied entry into Canada to compete in Krankworx, mandating he get a special visa at the consulate in LA well in advance of the event. Another example is my nephew who was in finance and was going in at Windsor, Ont. When asked why he was coming into Canada, he told them he was going in on business and that he represented a Canadian hockey player financially. They denied him entry and turned him back saying that a Canadian should have that job. What a joke, the hockey player, played on a US NHL team. If any of you mt bikers have a DUI, then you are not getting into Canada period. Check it out if you don't believe me. This is so typical of supposedly highly educated people that are blindsided by politics. Take note, that most countries have laws and the presidents, past and present have nothing to do with turning this Frenchman away.

 @bankz: i agree 100% with you. this has been going on for a long time. When speaking to a Customs officer, there is a huge difference between " I am going for work / business" and "i am going to work" - if you are going "to work", then where is your work visa?
When you go for work, it's just business, meetings, trade shows, ect....you are actually NOT working, but instead conducting business.

Pretty sure it was not in a democratic country. It's surely not the best moment in History to be american, but don't deny the reality. A few things are going much wronger than before there, and this Rampage story is just a non-serious illustration.

For those in the US and those from other countries, rest assured, Trump has actually put forth proposals to change our immigration policy to a merit based system, which would be very similar to Canada's immigration policy.

 It is quite misleading to simply blame Trump for any border security news, when it has nothing to do with Trump, or his policies. Even though I feel bad for Remy, he is the one that misread a visa description to enter the country properly. Hope he has learned his lesson for next time.

 I've been to Guam, Honolulu, Seattle both airport and land border, and JFK. The only time I thought I was going to be refused entry was the Seattle land border... when I was entering Canada. Those border agents were much ruder and obtuse than their American counterparts.

 @royhud: your right, I've witnessed the behaviour at us borders over the last 30 years, it's always been hostile and so it cant be due to trump. Various states and areas advertise to attract foreign tourists and then they get treated like scum on entry...is that really the experience they want?
I can tell you there are lots of people nervous of travelling to the US because of the hostile treatment they hear about.

 Actually, I've always found that among countries in which I do not need a visa to travel, Canadian customs officers are among the biggest pains in the butt. Of everywhere I've been, Russia is the worst. Not only do you have to fill out an extensive form accounting for your life's whereabouts and employment, once you do have your visa and get to Russian immigration, you're met with more warmth and friendliness.

I've been there twice for major sporting events, at the invite of the organizing committee, so I'm sure that had a lot to do with the ease of obtaining a visa. Customs in China is easy enough, though, as long as you have your passport and visa. Never been to India -- I would have thought it wouldn't be too hard.

As a professional, he should have had his shit squared away well before this event, it's not like he got the invite to rampage yesterday.  @TheR: I've never been to Russia, but I whole heartedly agree with getting into Canada. Nearly everytime I travel back into the country I'm genuinely worry about the moment I speak with a Canadian customs officer.

I once got pulled aside for screening because I had scrapes all over my knuckles. I told them it was from hitting brush while dirt biking in Arizona, I wasn't even 17 at the time....

 @TheR: maybe it's being Canadian, but I've never been stopped for even a moment coming back through customs. Coming from Mexico or Cuba, and telling the officer "yeah, we have a bit more alcohol and tobacco than we are allowed", they say they don't care and let us go through anyway without paying the extra.

Although, I'm the type of person that has all documentation ready to go and i don't cause a fuss, so I've never had an issue in any airport I've ever been in.

 @Katakalism: A Canadian citizen cannot be barred from re-entry into Canada. It's your guaranteed right as a citizen. That doesn't mean you cannot be hassled, searched, arreseted etc., but you WILL NOT be refused. Just like an American cannot be prevented from entering the USA.

What is actually happening is that he is going there on his own costs, bring his building mates on his own costs, will pay thousands of euros total just to risk his life to be able to say he rode Rampage, risk everything because Red Bull doesn't even insure the riders if anything goes wrong, to go back home again, thousands of euros lighter, purely to join this event that is the dream of most cyclists. These guys get paid to ride for a living. The vast majority of riders are getting paid indirectly for competing. The language of the law is that if prize money is awarded it's a competition, whether you get any money or not. This is important when it comes to things like insurance and visas.

By your saying he also can't go on a holiday to Whistler with his friends and upload a holiday picture onto his instagram, like all of us would, because he is a pro? In that case he would make money even more directly, because I'm sure he gets paid for his instagram. In case he doesn't; if a model goes on holiday and takes a selfie that she posts on her instagram, that she makes money with. She has to get a work visa or else she's not allowed to post that one holiday selfie?

It's all a vague line, even if there are (sometimes overly) strict rules. I just think it's overkill to say he looks like whining punk and deserved this.

 @fracasnoxteam: yeah ive considered it, i dont need $ to send it, if some1 offered me money to ride my bike, any amount would seem like alot as riding itself is payment enough. theres tons of people who send it this hard that will never get recognized or paid 5k to do it, so yeah 5000$ is alot of $ no matter how you spin it.

 You guys can whine all you want. At the end of the day he failed to obtain the appropriate work visa, it’s pretty easy to figure out that if you’re planning to earn income from a US source you cant enter using ESTA.

These international sporting events have a pretty straightforward process that should get athletes through with no problems. Someone taking care of his paperwork checked the wrong box or something.

 Because typically, people don't just show up in a country that requires a visa and then attend an event. They get the visa in conjunction with the event, usually through an invitation from the organizing body. It speeds things up and gets the athlete through the red tape easier. Also, the entry has he backing from a large, influential entity with money to make it happen.

Red Bull is not some fly by night company, and this is not their first dance, so I'm guessing they had everything in order, sent out the procedure, and someone got it wrong.

Now, I guess we can argue all day whether it's his fault or his sponsors, but generally, athletes don't take care of these things themselves. They have people -- managers, agents, sponsors, etc. -- that take care of these things for them. Athletes have their jobs; sponsors/handlers have theirs.

Although I am a big fan of Remy, he is a professional athlete, and he should have his paperwork in order if he is going to one of the main events of the year he participates in (whether with the help of his sponsors or not - I don't know what the usual arrangements are there). Hope he doesn't get too much shit in the future because of this precedent.

As for sponsors - they aren't responsible for the day to day life of supported athletes. You need to get your own shit in order, unless you have a manager (like some athletes do), then it's his/her job to do so.

 Funny you suggest that... Remi's Instastory when he was rolling up to the border guard included screaming at another guy in line about how expensive his bikes were and how he was a pro going to compete in this huge professional Red Bull event. Though idiotic, I wouldn't have expected him to have been flat out refused entry. Always best to make it very clear you are an amateur athlete.

I remember heading down to Sea Otter and a friend's dad said we were professionals (we clearly weren't!) to the guard. It resulted in hours of interrogation to ensure we weren't heading down to make a dime. After that, we were always going on 'a mountain bike trip', never 'racing'.

 Not the smartest move. They warn you NOT to do it. They have his passport information in the computers with the record of denied entry. They will just refuse him any further entry into the US. Call him and advise him against that. Not worth it in the long run.

 I had a girlfriend coming from Japan to visit me in LA and then we were going to a music festival together in Miami. She was a DJ but she wasn't performing. She arrived at LAX and never came out of customs. I waited at the airport for 9 hours. I got a call from an agent who said she was being sent back to Japan but he couldn't tell me why. (Confidential)
She was held in a small room with numerous other people for 24 hours without food and then sent back to Japan.
When I did get a chance to speak to her she said the agent asked to see her phone and looked at the photos and social media posts. Lots of photos of her DJing. She had mentioned that she was attending a music festival as a guest not a performer but, the agent didn't believe her. I spoke to immigration lawyers but there wasn't much they could do.
So yeah, this kinda bullshit happens all the time.

 Crossing the border into BC from WA usually takes about 30 seconds. The Canadia guy (or gal) smiles, asks a couple questions, sends us on our way. Done it hundreds of times going to Whistler. Every-single-goddamn-time we cross back into WA it takes an hour+ and we're always hassled by the border guards to the point of absurdity. Keeping in mind I'm a card caring Government employee with a security clearance. I'm not surprised in the least Remy got screwed.

The tax reform, however, reduces the federal income by about 5,000,000,000,000.00$ a year on a statistic basis and since the underlying principle is "America first", it's only a logical consequence that money flow from U.S. to the outside would be at the very least massively impeded, if not frozen completely.

I was travelling to the UK with my daughter (her mum is Japanese, but that time she wasn't with us) for a holiday to see my folks in the UK...

So,think about what they see: A single male traveller in their 40s with a female child (whose appearance is somewhat different to the male) under ten years old and no sign of a mother. If they DON'T stop me and question me, you could say they are not doing their job properly.

And to make matters worse, the UK Passport agency had printed her DOB the wrong way round (E.g. 21st instead of 12th), so when they asked me her DOB and I told them, all they kept saying was "That is not what I have here SIr on the passport" and me saying "Well, I saw here head pop out of her mum on the 12th, and I don't care what the passport says... get people who can read birth certificates properly in the office then!"

An hour later, they said they were prepared to believe me and not the passport, and in we went. Poor buggers, I called them all kind of names.

 When I raced Fort William I was held and questioned for no real reason and on the way back home from the 3 week trip I had a lay over in Switzerland after racing Val Di Sole and they asked what I did and said I was racing mountain bikes and I got questioned whether or not I made money. 18 years old and traveling alone doesn't help much but this stuff happens in different countries too. Also "they still think i'm going so I can make money" come on Remy, that's exactly why you're going. You're a professional mountain bike athlete, competing in a professional mountain bike freeride event. The key word here is "professional" meaning its what you do for a living, its what you do for money. So yes, you're planning on making money from this trip while competing at this professional event. Yes it sucks, but next time definitely say you're going bird watching! haha

 Gotta be honest, as tempting as it is to harp on USCIS with this one, the reality is that this one is likely Remy's fault. As a Canadian living in the US and dealing with countless visas etc this sounds like Remy's team just didn't get things organized far enough in advance. Traveling abroad for competition that involves monetary compensation (in the US) isn't something new to a pro rider. That said, I could certainly be wrong. Gonna miss ya Remy!

 @RichardJBos: Well no he isn't a Red Bull sponsored athlete but he is given a flat fee for him and his dig team. Outside the bike industry Red Bull is my biggest client for close to 20 years. I know how these events are produced. (More on the culture side than sports). There are approximately 12 athletes, 10 of which are pre qualifiers. It wouldn't be that hard to have someone manage and follow up with riders. In the music industry we do this all the time.

 I was at whistler during crankworks, I was sitting in this little café when Remy came over and sat at the next table over. I walked over and started talking about his bike and how cool it was, we got to talking for a second about biking and bikes and stuff. Nicest guys ever, I didn't even know it was him until I saw his name tag on the bike. I asked him what he was up to for the rest of the season and he replied (in a french accent) "nothing serious until rampage". He is such a nice and humble guy. For someone like that to be denied into a country based on the fact that he is there to "Make Money". I go to Canada once to twice a year and every time I come back Border Patrol gives me a hard time, like guys I live here, let me go home. I understand they need to be strict but let people be. He is a world renowned professional athlete, he int there illegally or to cause harm. He is there to do what he loves, let him do that

 This is a reasonable take but you are misconstruing the situation if you think he's being denied entry simply because he is here to possibly make money. The issue is that he didn't obtain the proper paperwork required for someone who is going coming here to essentially work. If he did there would be no issue with him getting in. I think it sucks he won't be at Rampage too but at the same time there are fairly simple rules and documentation that need to be followed when people come here to work.

 Not sure how he could ever argue that its not part of his job and ultimately paid employment to be at rampage. Financial gains from the event itself are irrelevant when hes being to paid to be (receiving money in return for) riding a bike wherever he is.

There is a good chance you could win if you're like Brandon or sink but in the best both riders have crashed out. It's the 5000 travel rebursment that gets you. But even then it's a grey area.

 There's a law firm in California that focuses its practice on action sports, including immigration and visa issues. 5 minutes with Google plus a few hundred bucks would have likely made this a non-issue for Remy, assuming he'd gotten organized well in advance. Alternatively, he could have asked any number of pro mountain bikers that he's liable to know personally and have contact #s for and they would have told him the same thing.

But not bothering? When you're going to what is said to be the most important event of your season and your career? That's not professional. Costs be damned. If not being at Rampage is a career limiting move, you organise it properly.

 Just went through US immigration process since my wife is from here. I can tell the whole process is bureaucratic bullshit, expensive, frustrating and long. They treat you like garbage, the system is built to be a business like everything here, there's no way that you will get help from them, they refer you to immigration lawyers for everything, a complete ripoff. Homeland security does the worst job, their system is totally archaic you have to send by mail all documentation hoping to get back a received notice, and then back and forth at least 5 times. They keep good people like me or you out making the process super hard and motivate others to immigrate illegally. I must say, once you're in you might be riding the best trails in the world. I'm totally amazed of how developed the trail systems are and how apps like trailforks or mtb project have everything mapped so you can go wherever and shred I hope everyone in this situation finds success in their journey I know is hard but you all gotta stay strong. Last note, visajourney.com website was really helpful answering all the questions I had, since there's no official help more than lawyers, the community there is big and friendly, you might wanna take a look

 I have traveled to a lot of counties to install equipment for my company and 99% of the time there is an issue even when all the paperwork is right. Plus even better is all of these trips have been to install equipment at some government agency for that county or the US (military base or embassy). I can only think of one where I had no issue and that was Indonesia.

So yeah its not just the US, its a lot of counties.

My wife often flies into Vancouver and drives down to Seattle for work. She finds it easier to do the border crossing with her Canadian passport than flying directly into the US on a NZ one. Less questions asked.

 Well, I have 2 daughters, born in the USA, but we live further down south, and my wife just got denied a renovation for her tourist visa, wich she's had since she was like 8 years old and is now 33.. Maybe it's just a coincidence that this happened during Trump's administration, maybe it's not, all I know is that immigration officers are autonomous in denying or granting acces to the US.. I'm sure Remy has used the same story in past years, to get in the country, but maybe the immigration officer broke up with his girlfriend or something that day, or was just having an off day and took it out on Remy.. it happens.. But I agree that he should've prepared properly and applied for the right visa from the start..

 I probably wouldn't have made it either. I recall traveling to Canada a couple of years ago and having a transfer in Washington. A bit in a rush I thought it was clever to drop my small backpack (which I carried as hand luggage) to put the big backpack on my bag and then hold the small backpack in my hands when running. The officer didn't quite like that quick juggling of bags so went "we've got to talk, buddy". That's when I missed my flight. I admit I'm probably naive and I usually look like I have already exploded (you need to make yourself comfortable on a long flight, I thought). He was naive too though. If he doesn't like me in his country, he'd better make me catch my flight Wink .

 This and any other border stop has little to do with current administration. Three years ago I had some troubles re-entering the US as a US citizen, but that wasn't Obama's fault. It was just a bad application of protocol and policy and a mix up on paperwork. Another time a guy in my group got sent back to the US by Canadian border patrol and couldn't come to Whistler with us. He didn't get the required paperwork sorted out before leaving and thought it would work out. Would you say that was Trudeau's fault?

 It's not just America. I've had 10 trips to Whistler over the years with no issues. Never caused any trouble & spent a large amount of money supporting the Canadian economy in that time. This year with the introduction of Electronic Pre-screening I was refused entry to Canada due to me having received a very small fine for possession of a very small amount of bud (4g) here in the UK over 20 years ago.
It's is becoming a global problem and pretty soon any misdemeanor, however small, will negate your ability to travel anywhere outside of your home nation.
