does anyone in your family no a police officer or anything? most cops won't really help, but you could just call anyways to see if they do. but if your family member or family friend is one, they most likely will help you out. i'm pretty sure its illegal, so if you do have a cop in your family. contact the family again, saying that your going to have to take law enforced actions, and already have a police officer behind you if they don't reverse the deal.

O+

Call him/his mother and tell them that it's their last chance to redeem themselves before you pursue legal action. What he did was illegal and both him and his mother know it. They're trying to scare you off by making up some harassment charges, which wouldn't be legitimate any way that you were to look at it.

They screwed you out of a lot of money, you have every right to contact them and take legal action. Whatever you do, don't let this little sh*t-head get away with what he has done. If you do, he'll grow up thinking he can assf*ck people out of their hard-earned money and maybe scam one of us. Even if you're not going to make a lot of money out of any legal action you take, do it just to put the little sh*t and his mother in their place. It'll be worth it.

I feel like the most unintelligent people I have ever been exposed to are all from Pinkbike. It's like it's a sh*t show of internet morons who have the IQ's of coconuts.

It's YOUR fault for not having x-ray vision and seeing that the internals were different, come on, lol.

She cant file harassment charges and win for you bugging her about you getting ripped off. Probably some dumb ass redneck lady.

Go there with your dad and a few of his and your friends and get ur shit back.

Dude i sent him an email saying theres a lot of people wanting to hurt him and i put all of his info on it so he knows that we know where he lives!

Ah, the typical answer of a juvenile adolescent. If I was on the receiving end of a message like that, prepare for the police to be knocking on your door as a threat is a very serious offence and so is harassment.

Actually, as someone who worked as a network security admin, and as someone who's job it was to investigate complaints just like this as well as worse crimes such as child pornography, I can say with a professional opinion that police would very likely not be able to investigate this very far. Investigators would have a tough time obtaining search warrants/court orders on at least 3 separate entities spanning at least 2 provinces and possibly across the border. Further to that, log files on the servers would have to be complete, assuming they weren't purged in the time it took to ge passed all the red tape. After that, a case would need to be built, of which harrasment and especially threats of physical violence would be very tough to argue.

99.999% of the time, these investigation end after a single email is sent.

Unfortunately, the only legal action he can take here would be a small claims action, as I'm guessing no bills of sale were signed/exchanged, and both forks were used by their previous owners. Also, posting their contact information on the net in this situation could border on lible, which is just a bigger headache for you.

Like was previously mentioned, take your dad and a few people that know their parts inside and out and go to the tool's house and confront him and his parents in-person. Everyone is a bad-ass behind a keyboard, but not so much with the other person's breath in their face...

I don’t think you will be able to get anything by taking this to court, most likely they will dismiss the case for lack of evidence. The best you can do is go to his house and demand your totem back in exchange for the boxer, and maybe some money for all the trouble. However it is a very delicate situation, the kid’s retarded mom might call the cops on you for “harassment”.

Is there any way to be completely sure that his mother sent you that email? I'd say it's pretty likely he did that. Try to get her on the phone before you draw any conclusions about that.

I think at this point it's not all about getting his fork back (which was new, not used), but also about teaching this kid and his irresponsible parent a lesson.

Of course the case would go to small claims court, it's a small claim. Also, I don't think that this guy who got scammed is a kid, so not sure about the whole bring-your-dad along tactic.

I think a very formal letter threatening legal action would do the trick.

I have been VERY polite through the e-mails and my message in their voice mail.

I CAN'T contact them because they are not picking up their home/cell phone, nor would they answer their voice mail or e-mail.

Exactly. I don't care about the money, I want to make sure that this kid and his family NEVER be allowed to commit fraud to anyone else again.

Contact them at the same time every day, to the minute and be extremely polite. Pre-write something and just read it off everyday at the same time on their answer machine and also email it to them. Then, if they actually contact you, just be extremely nice, even if they are complete a-hole. When people are pissed and yelling at you and you completely keep your cool and agree with them or be extremely kind it pisses them off so much more. No, this probably wont solve anything, but at least if you contact them on a daily basis and are extremely polite about it, if they do press harassment charges you can just say that you were being polite and trying to contact them with a problem about the purchase and they wouldn't respond. Play dumb, say you didn't know they got the message.
