DB release 29 2 issue

Have an issue with a brand new db release 29 I got this week. Drive side crank hits the chainstay under heavy pedaling. Have about 15mm clearance on non drive side, but only 5 or 6mm on drive side. I have a release 2 as well to compare it to - crank clearance is equal on both sides. Crank arm doesn't appear bent and bb is properly installed with single drive side spacer. I used string and tape measure to check frame alignment and seems ok. Q factor seem correct and centered on the frame. Compared to release 2, only thing that seams odd is chainstays dont have as much curve inward toward the wheels on the 29er. Seems to be 6 to 8mm wider from stay to stay than My release 2 right where the end of the cranks pass the chainstay. My understanding is this bike is a catch frame with 29" wheels. Hoping any catch owners could tell me how much space should be between chainstay and crank arm.
At this point, think I may have a bent or deformed rear triangle from the factory.
I have ticket opened with db and waiting to hear back.

Just shy of a year later... After a long drawn out interaction with DB support, jumping through hoops replacing parts I knew wouldn't fix the problem, and taking bike to my lbs to " confirm" the rear triangle is bent, they finally sent a replacement rear triangle. Unfortunately, they sent a matte black part (tech stated all replacements are matte black), the eyelet for the top pivot was too small for the bolt, and the rear axle threads were hosed up. I reopened my ticket and havent heard back in week

Man that's a total bummer! Glad you finally got it fixed. I just got a Release 3 a few weeks ago and fortunately no issues thus far *knocks on wood*

Well, after 2 rides it developed a little bit of a creek in the pivots and a nasty creek and click in the headset. I will be tearing it down in the next couple of days.

Worth checking while you have it apart, but make sure the chainring is tight on the cranks. I had to lottie mine.

Perhaps Diamondback may not be the way to go. Whip
