Industry Veteran Hans Rey Calls for Clearer E-Bike Definitions in Open Letter to the Bicycle Industry
We are over-complicating ebike regulation - weight and speed are easier to understand, easier to post, and easier to enforce. - 85 lb max unloaded system weight or it's a regular motor vehicle, let trails post smaller limits if they want - Context dependent speed limits assisted or not: - 10 mph on MTB trails and ordinary sidewalks unless posted higher - 15 mph on designated bike paths or multi-use paths unless posted higher - Road speed limit on roads up to the 30–40 mph range that mopeds already operate in and is the max human powered speed That framework makes more sense than obsessing over throttles or peak vs nominal watts. Let a bike briefly use high power to get over an obstacle, climb safely, haul cargo, or help a disabled or fatigued rider keep moving. But do not let a 150-pound unlocked bike rip through sidewalks, shared paths, or trails at traffic speeds and call that the same thing as a bicycle. We are not going to regulate away reckless behavior completely. At some point, dangerous riding has to be handled the same way as other dangerous behavior - through law enforcement and consequences when people create risk for others or destroy shared spaces/trails.
