Retrospective planning permission is granted very often and it sounds like reasonable measures could have been put in place to make the track acceptable however the council wanted to make an example of them. Enforcement action is an expensive undertaking for the council so either they were looking at a fine from the Environment Agency unless action was taken or a well connected person was making life very uncomfortable for the councillors and planning department
