Lots of legit building clubs going on all over. Get involved with your local trail builders. Everywhere is a bit different.

The official answer in most places is yes, you need permission from the land manager. The real answer is only if you get caught. Most land in canada at least is owned by the government and if you are willing to go far enough up logging roads or hide the trail in a more well known area people likely won't catch you. I don't know what the guys in this video did
