New CPSC Regulations on 24" and smaller bikes

Some of you may have heard about these new regulations and thinking what are they, and what/who do they impact? There is stuff popping up all over biking websites about these new regulations, and people asking questions about it. I got a little inside info about it from the BMX coordinator at Norco Bikes.

Read on to find out more about these new regulations.Basically, CPSC is a new law/regulation that makes it so all toys have to get tested for lead in their paint. You are most likely thinking 'toys', bike are not toys. Well, the sad truth is that anything with the wheel diameter of 24" and under is certified a toy.

These rules are all not that bad though in the context they were made for. It's simply to prevent kids from getting levels of lead in their bodies if they lick or put toys in their mouth. Dumb, I know. You are now thinking, why not change the way a BMX bike or 24" MTB is certified so it's not a toy. It's harder then you think, and bike companies can not do it or else it would have been done by now.

These regulations are implemented by the USA, and all products being sold in the USA have to under go tests to make sure they have less then 600ppm of lead in the paint. You are saying just sort it out and choose frames and parts just for the USA. Companies have no idea which frame or part out of their line will reach the USA, so they have to test all batches of products. These new rules come into effect on February 10th, 2009. So, all companies that don't sell all their products that don't fall under these regulations by then, will have to destroy all their products as it will be illegal to sell in the USA.

The costs of the samples are insanely high, as they are $1500 a sample. Will this mean that prices of bikes and parts increase? We do not know that as of now. Some companies may have to increase their prices to adjust to the cost of each test. If the company raises costs, it won't effect just the products sold in the USA, but everywhere else too. Most of these companies are trying to not push their prices up, but instead decrease funding in certain areas to make up for it. Some are just going to suck it up, and not increase prices or decrease funding in any areas. The one thing you WILL notice is the decrease of different colors and less and less LTD colors. Expect more white and black parts in the future of BMX.

Some of you may also be thinking, will this see the end of some smaller companies? Most likely the ones already out there will stay, but expect less start up ones coming out. Also, will other countries follow these ideas? Who knows right now, but most likely there is a chance.

So, overall, when you go to buy new parts and you notice the price has increased or they no longer make the color you want, keep all this in the back of your head and realize that it's not BMX/MTB companies doing it. It's the new regulations.

 The following should help explain this. Not saying I agree or disagree with the lead regulation on bikes however.

I work in the health and safety industry, and regularely do lead paint testing. The tests (not sure which ones they will use) usually cost around $50.00 to determine the lead content of paint, although they may be using a more expensive test criteria. This should not be a difficult regulation for the industry to follow.

For children, the primary route of entry for lead exposure is oral, by either putting a painted surface in their mouth or by touching it and putting their fingers in their mouth. This regulations is most likely aimed at younger children.

A similar regulation exists for household paints (under the US Housing and Urban Development program) because there is widespread developmental damage to children in the US from lead paint exposure, because younger kids are much more sensitive to the effects of lead exposure.

Hope that helps explain what seems like an arcane regulation.

 I thought it was ridiculous when I read that these regulations also apply to books. It's even more asinine with bikes. if a kid's chewing on paint chips from his bike like it was candy maybe he deserves to be culled from the herd. or maybe at least his parents should be.

 It is funny that its consider a toy in the US, especially since if you are caught riding one to fast, or on a sidewalk in some areas, or just in general at lets say a stair set at a library, you walk away with a vehicular mischief ticket. What BS! As for the price increase on parts, if you ride 20 inch, just stick to Dan's comp! they are the best that I know of for new parts pricing

 Nelson, you may not know this but if you havent already that ticket is totally fightable. Had the same thing happen to a buddy of mine and the whole 24" = toy thing saved his ass, judge dismissed the case after he brought the bike in and a copy of the actual cpsc statement... he just said, "if I'm riding a "toy" how exactly is that considered a "vehicle"... Judge said the cop could have ticketed him for "malicious mischief" or "disturbing the peace" but not vehicular.

 so you're saying that led is bad for us, but aslong as we ride a 20 or 24inch toy we're all gonna be saved from the led o' doom, BUT if you ride a 2six bike, you're gonna suffer from the led o' doom?! it doesn't make sence tbh, so whatabout companies liek NS that make the suburban in 24 and 26versions, the extra mm on the frames means they need completely different paint lol? ohwell, funny times eh?

 Not different paint, just paint that falls under the regulations. I'm sure they will most likely use the paint on both of their 24 and 26" frames, as it will most likely be a better alternative for removing lead out of stuff like that.

They are made to protect paint in Walmart and those bikes sold in department stores where the MAJORITY of the bikes under 24" are sold.  All products made in the USA, and painted in the USA have to get tested too if being sold in the USA. There is lead free paint out there, but I don't think it's any good to be used on metal.

 Unfortunately I think this writer grossly underestimates just how much this will impact the US BMX industry. Canada will suffer too as stated, no one knows which parts will come to the US. Get ready to see the small market companies go bye bye or start making 26" products only. No one but the big companies will be left. Only ones making MTB's as their main products.  I don't think it will vanish the small companies, but more so prevent new ones from being created. There is a thing up on BMXUNION with questions to BMX company owners about this and none of them are thinking that small companies will go bye-bye. They will just have to slightly increase prices, and slow down manufacturing. Example of small company is Seshin BMX. It's a Canadian company, and you will not be seeing it disappear anytime soon.

 Yeah, its the Government, nothing happens over night when it comes to the Government. The chances are minuscule that that petition will help, especially with a start up date so imminently approaching.

The cycling community may seem large to us simply because we are well informed, only due to the fact that it is our passion / hobby. I don't think it seems that large to an organization that is trying to keep children safe, from a potentially dangerous situation.

I see their point calling a BMX bike, a toy. A BMX was my first bike when I was 3. Plus, traffic laws state that it is illegal to ride a 26" wheel bike on a sidewalk because it is classified as a vehicle and must be ridden on the road. So 24" wheel and under bikes are considered toys because usually only kids ride them, on the sidewalks and not on the roadways. If they reclassified BMXs as vehicles then they would have to amend the law to state, all bikes with wheels sizes 20" and over should be ridden on the road, and not the sidewalks. The roads are not the safest place to be riding a bike whilst learning. Look what happened to Rachael Atherton, and she is a pro at riding bikes.

I agree it sucks, but it seems to be the trend these days. You gotta keep your consumers and their families safe, so they will spend more money down the road. Its what drives the economy, its what keeps the tax dollars rolling in.

 Docta, color is not an issue here... it's the paint that needs to be tested - NOT different colors of that same paint. If a paint has the accepted lead content level, it can be produced in different colors without testing all the colors. It's the same paint, regardless of the color.

 think the safest bet would be to buy a bike now before the prices hike up!! can see them stoppin ppl paintin their own bikes tho.

jus thinkin tho, surely the sample cost (1500) doesnt apply to every frame i.e. out of 1000 frames a small number will be sampled so divide the sample cost by the number of frames and ur talkin a really small price increase.

 OK so just to clear this up, what does this effect? regardless of where parts or bikes are bought 99.9% are made an painted in the far east.why cant the factorys be tested instead of the bike companys products,oh yea because most far east factorys like the officials that thought up this crap are corrupt!
what about hand made/home grown products that never go any where near china,i think they still need to be tested if they gonna be sold in the u.s
i can see the point in mass produce companys like haro or mongoose but not when it comes to companys like S&M or curtis for instance

 Yes you can. Any bikes with a wheel size over 24" is not considered a toy, and has to follow the same rules as a vehicle. Ones under are considered a toy, and don't follow the rules that bikes over 24" wheel size do. Different rules can be applied on bikes with different wheel sizes.

 i'm just thinking about u.k companys.they gotta pass on the cost of this testing to the customer.maybe they could ONLY increase the price of bikes/frames/parts exported to the u.s if its they who want this testing. i have a frend who works in the industry an already one major rider owned/run u.k bmx company(who have major sales in the u.s) are having trouble with the price increase

 these regulations have been in the works, i remember hearing about these a while ago, there are quite a few more regulations to come on 24" and below too. this is just the start. and as for 26" bikes, thoes are big boy bikes not childerns we don't lick our frames (unless to much acid is involved)also i bet you could look at how many adult BMX bike are made and i bet more childern bikes are sold and made. so why should they make aceptions for a nitch market? apples are apples and a 20" bike is a 20" bike in the governments eyes.

 okay everyone seems to be missing the point here and asuming that bike prices are going to skyrocket and small companies will instantly die, most us regulations like this have many rules and fine print. althought the price of testing is high if your factory regularly passes tests than you will be tested less, as for small companies most of them have the sence not to use shit paint anyway, also the final reason this isnt as bad as you all think it is is that, nobody here is looking at how much lead they allow if you have ever looked at how much lead is in bike paint you would see that most bike companies are already well below standard, also if you brits are so smart than how come so many of you asked if this would affect you of coarse it will affect you if the price of a haro goes up in the US then it goes up everywere dumbass there not going to lower the price cause your from the uk or canada.and instead of bitching so much maybe all of you should get together and do something about it write some letters experes your outrage on somthing that the people making this law will see. lawmakers dont like pinkbike, come on people be constructive

 Your absolutely right. Im sure they have some sort of points system like they have for oil company's. Oil company's buy cars from junk yards and get points allowing them to pollute legally. So im sure there going to do something like this for large bike company's. what this means is smaller company's wont be able to compete. Every time they want to put a new bike or part out they have to piss out over a grand for every new part on that bike and COLOR so it can be tested. So we will not see any new small start up company's from the pro bike riders any more Frown

 well you see most small companies use powder coating which doesnt have lead, and any company would save money in the long run to powder coat anyway, and the ones that still paint normaly use high grade paint to attract customers. small companies also have inheritly more expensive products anyway. also they arent testing every part on every bike they will be testing all the paint on one bike per batch which isnt that much should raise the price of a bike more than a few dollars

 I used to powdercoat at lighting cycles powder coat all tho polyester based contains lead based pigments and powder coat from china has tons of lead in it. Company's contract there parts to be built in Chinese build houses who powdercoat the parts as well. They are testing every new bike every new part and every new color. What this does is add extra cost to putting new parts and colors out it also adds time to how long it takes a part to leave research and development and land on store shelf's.

iv never known a child under the age of...what 4? being able to ride a bike completely on its own and at free will. all bikes are a mode of transport, and a mechanical device, mass produced for work and pleasure, i think its rather offensive to us "die hard" riders who ride bmx and 24's to be generalized into the "Playing with our toys" category. it makes us sound like f*cking children.

 Actually, the funny thing is I was inspecting an asbestos enclosure today and a couple of contractors were in there messing around in the stuff with no masks on. So ya, lots of people are actually that dumb. I just thought I would add that cause its hilarious.

 I dont know if this has been mentioned yet, but this isnt just affecting all our favourite bmx companies. The law is propably more designed for bikes from wal-mart and k-mart, which im sure you all agree are "toys" and companies that produce these bikes are most likely going to the ones using lead paint, not haro or sunday.

The government though cannot just pass legislation that says any bike from k-mart/wal-amrt must be subjected to lead paint testing. Simply they do a survey and find most kids 12 and under ride a bike that is under 24" wheels. Now i guarantee you that 90% of these kids are just riding bikes from k-mart, and its those who this regulations are targeting, but for the rest of the companies making bmx bikes, it will be a regulation they must do.

Just out of curiosity though, why cant these tests be done one step back at the source where the paint comes from?

 Holy carp. Paint chips aren't the issue. Any contact kids have with lead (i.e. touching a lead-painted surface) and then eating food, smoking a fattie, eating an apple, etc. has a potential impact on their intelligence. This isn't just a paint chip issue. The acceptable exposure level for lead is really really low for kids. Most paint colours do not require lead. It whitens, brightens, and adds longevity to paint colours, but it is in no way required to make good paint. I suggest that the industry suck it up and source their paints better. In my opinion, this issue will affect the industry for a year at most, because Chinese factories can source better paints as well as anyone. The retail house paint market went through this same changeover and is still around.

 This is not getting to the heart of the problem. There should be a law against lead being added to paint in the first place. It should be the responsibility of the paint manufacturer to have tests conducted on their paint by independent testing facilities, and the cost for those tests should be covered by the paint manufacturers themselves. Then if there are any traces of lead found in products it can be traced back to that particular paint company and they could either be fined or shut down completely. I know the biggest problem with that idea is the lack of control we have over what goes on in China and other foreign countries, but maybe its time to start bringing more manufacturing jobs back to North America anyway... but thats a whole other topic.

 All we had to eat when i was a kid was pencils and acid rain and the only transportation we had was bikes made of only lead based paint and I'm fine. also my parent's were painters and we lived in a lead mine.

 some companies actually do its just not announced like if you want teal go to europe if you want red order from mongolia it depends on the market its like how in north america the old jackal came as frame only but for a while you could get it in a full build in europe

 Not many BMX companies actually do it though. They all make the same frame, and paint it the same colours for all the countries. VERY rarely you will see something like that. Custom order, maybe.

 I hope that you are trying to make a joke because you can anodize any that can conduct an electrical current. Also in case you did not know anodizing come in a wide variety of colors and textures. You can also have "marble" or "rainbow" effect with anodizing.

Also anodizing is way stronger than paint and lighter because only a thin layer of material is applied compared to painting where you have at least 3 layers (base coat, actual paint, and clear coat(s)).

 You saying you would strip the paint because its making the bike lighter? And yeah. There is few color options, but cheap walmart brands will do the coatings as cheap as possible. Im a car painter, so i can say that painting is the way to go...

I don't even know where to start. who talked about stripping paint? Paint is heavier than anodizing PERIOD. I've tried to say they should start anodizing instead of painting because of the current problems with lead. Also you are saying that wallmart will make cheap coating, of course they will. Last I've checked wallmart was not selling bikes like the ones you see on this website.

Your arguments are stupid and unfounded, you assume thing that i did not remotely say. the only disadvantages of anodizing you should have tried should have been:

- anodizing is expensive when making a small batch,
- anodizing does not have metallic, pearl, or candy finish,
- anodizing does not have as much shine as paint because of the lack of clear coat.

In addition, you could have talked about powder coating, maybe it would have added a "layer" to your argument as we are talking about the lead content in paint and kids sucking on it.

 After reading more of the comments and making some research it came to may attention that most bmx frames are made from steel which anodization process equivalents are galvanization and the widely know stainless steel.

Color sequence for stainless steel:brown-blue-yellow-redish or brown-purple-green.

 I think they will still continue what they are doing now, just drop a few colours and do a LOT less LTD colours. Stick to the basic black and white frames, and that. How many companies will actually anodize their whole entire frame though?
